Domanda per Accertamento di Conformità ex art. 37 D.P.R. 380/2001
<p>Si precisa che, a seguito dell'adozione dei moduli unificati e standardizzati della richiesta del Permesso di Costruire, della Segnalazione Certificata di Inizio Attività (SCIA) edilizia, della Comunicazione di Inizio Lavori (CIL) e della Comunicazione di Inizio Lavori Asseverata (CILA), approvati dalla Regione Campania.</p>
<p>L'elaborato dovrà essere formalizzato in apposita cartella, faldone o raccoglitore dell'intera documentazione, pena il non accoglimento dell'istanza: non verranno prese in carico dagli uffici del Servizio fascicolature precarie (elastici, graffette, spillette, ecc.).</p>
<p>L’art.37 del Testo Unico per l’edilizia disciplina la sanzione pecuniaria per gli interventi edilizi realizzati in assenza/difformità dalla Segnalazione Certificata di inizio attività -ex Denuncia di inizio attività.<br />
Com’è noto, l’art. 49, comma 4-bis del Decreto Legge 31 maggio 2010, n.78, convertito con modificazioni dalla Legge 30 luglio 2010, n. 122, disciplina la Segnalazione Certificata di inizio attività (S.C.I.A.), sostituendo integralmente la norma relativa alla Denuncia di inizio attività contenuta nel previgente art. 19 della L. 7 Agosto 1990, n. 241.<br />
La nuova disciplina ha imposto la necessità di un adeguamento del procedimento da utilizzare al fine della sanatoria di opere nei casi di cui al richiamato art. 37.<br />
Pertanto, viene introdotto specifico procedimento finalizzato esclusivamente all’ACCERTAMENTO DI CONFORMITA’.</p>

<p style="margin-left:0cm; margin-right:0cm">Le richieste legate alle certificazioni/attestazioni ed atti vari di cui alle lettere A-B-C-D-E-F-G-H-I-L, possono essere avanzate con “carattere di urgenza” (evase cioè entro 5 giorni lavorativi consecutivi dalla data di ricevimento) ma comportano il pagamento dei diritti (segreteria e istruttoria) nella misura doppia: non rientrano nel computo del periodo di cui sopra i giorni necessari alle società detentrici gli archivi pratiche edilizie.</p>
<p style="margin-left:0cm; margin-right:0cm">Tutte le richieste di cui al punto precedente devono recare l’attestazione dell’avvenuto versamento dei diritti dovuti, in mancanza dei quali l’ufficio non procederà alla lavorazione e successivo riscontro.</p>
